Terms & Conditions

The following is a list of terms & conditions of our services:

BY RENTING, ACCEPTING DELIVERY OF, OR USING ANY EQUIPMENT FROM EASY HAUL INC, CUSTOMER AGREES TO BE BOUND BY ALL TERMS AND CONDITIONS OF THIS AGREEMENT.

  1. EQUIPMENT COVERED

This Agreement governs the rental of any equipment provided by Easy Haul Inc, including but not limited to:

  • Portable Restrooms
  • Restroom Trailers
  • Handwash Stations
  • Holding Tanks
  • Construction Dumpsters
  • 20’ Conex Storage Containers
  • Any related accessories or equipment
  1. DELIVERY, PLACEMENT & SITE CONDITIONS
  2. Portable Restrooms, Handwash Stations & Holding Tanks

Company shall place portable restrooms, handwash stations, and holding tanks at the location designated by Customer.

Customer expressly acknowledges and agrees that:

  • Company is not responsible for securing or anchoring any restroom, handwash station, or holding tank.
  • Customer is solely responsible for properly securing and stabilizing all units based upon site conditions, weather, terrain, and usage.
  • Company shall not be responsible for any damage, loss, or injury resulting from units tipping, shifting, falling, or otherwise moving.
  1. Dumpsters & Storage Containers

Company shall deliver dumpsters and storage containers to the location designated by Customer.

Customer acknowledges and agrees that:

  • Company shall not be responsible for damage to yards, lawns, landscaping, septic systems, sprinkler systems, driveways, pavement, curbing, or underground utilities resulting from delivery, placement, or removal.
  • Customer is responsible for ensuring the designated location is suitable for heavy equipment and free of hidden hazards.
  • Company will exercise reasonable care during delivery and removal but assumes no liability for property damage caused by site conditions or placement location selected by Customer. 
  1. PROPERTY DAMAGE & ROAD HAZARD DISCLAIMER

Customer agrees that Company shall not be liable for:

  • Any damage caused by rocks, gravel, or road debris striking vehicles, structures, windows, or other property during transportation or operation of equipment.
  • Any indirect, incidental, or consequential damages arising from Company’s performance under this Agreement.
  1. CUSTOMER RESPONSIBILITY FOR EQUIPMENT

Customer agrees that:

  • All rented equipment shall be used only for its intended purpose.
  • Customer shall not abuse, misuse, overload, alter, or modify any equipment.
  • Customer is responsible for protecting all equipment from theft, vandalism, weather-related damage, and misuse.
  • Customer shall be financially responsible for repair or replacement costs due to damage, theft, loss, or destruction occurring during the rental period, except for normal wear and tear.
  1. LIABILITY FOR INJURY & DAMAGE

Customer expressly agrees that:

  • Company shall not be liable for any personal injury, death, or property damage arising from the use, placement, securing, or condition of the equipment once delivered.
  • Customer assumes all risk associated with possession and use of the equipment.
  • Customer agrees to defend, indemnify, and hold harmless Easy Haul Inc, its owners, officers, employees, and agents from any and all claims, damages, losses, liabilities, costs, or expenses (including attorney’s fees) arising out of Customer’s use, possession, or control of the equipment. 
  1. PROHIBITED MATERIALS – DUMPSTERS

Unless expressly approved in writing by Company, Customer shall not place the following materials in dumpsters or containers:

  • Hazardous or toxic waste
  • Liquids
  • Tires
  • Batteries
  • Chemicals
  • Explosives
  • Medical or biohazard waste
  • Asbestos or asbestos-containing materials

Violation may result in immediate termination, additional charges, and full liability for fines, cleanup, or disposal costs. 

  1. ACCESS & SERVICE

Customer agrees to provide Company with clear, safe, and unobstructed access to the equipment for delivery, service, and removal.
Company shall not be liable for service delays or inability to perform due to blocked access or unsafe site conditions.

  1. PAYMENT TERMS
  • All charges are due according to invoice terms.
  • Failure to pay may result in service suspension or equipment removal.
  • Customer agrees to pay all costs of collection, including reasonable attorney’s fees, court costs, and collection agency fees, where permitted by law.
  1. DEFAULT & TERMINATION

Company may terminate this Agreement immediately, without notice, for:

  • Non-payment
  • Unsafe conditions
  • Misuse of equipment
  • Violation of any term of this Agreement

Upon termination, Company may remove equipment without liability.

  1. GOVERNING LAW & VENUE

This Agreement shall be governed by and construed in accordance with the laws of the State of Alabama, with venue in the courts of Alabama.

  1. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the parties and supersedes all prior negotiations, representations, or agreements, whether written or oral.

  1. ACCEPTANCE OF TERMS

Customer acknowledges and agrees that acceptance of delivery, use of equipment, or payment for services constitutes full acceptance of this Agreement, whether or not Customer has signed a separate written copy.
